These Terms and Conditions govern your access to and use of AWE13.com, including all content, features, forms, and services made available through the website. The website is owned and operated by Ali Weitzman Events LLC, referred to in these Terms as “AWE,” “we,” “us,” or “our.” By accessing or using this website, you acknowledge that you have read, understood, and agreed to these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, please do not use the website.

1. PURPOSE OF THE WEBSITE

This website provides information about Ali Weitzman Events and our event-planning, event-design, branding, consulting, and related services. It also includes examples of past events, photographs, testimonials, design concepts, and other information about our work. The information presented on the website is provided for general informational and promotional purposes only. Your use of the website, submission of a contact form, or communication with AWE does not create a client, planner-client, consulting, or other professional relationship. A client relationship is created only after AWE, and the client has signed a separate written service agreement and any required deposit or initial payment has been received.

2. EVENT SERVICES

Descriptions of our services, past events, designs, photographs, testimonials, and other materials are intended to provide a general overview of our work and capabilities.

Website content does not constitute a binding offer or guarantee that:

  • A particular event date will be available;

  • A particular service, vendor, venue, product, or design will be available;

  • A particular event result can be achieved;

  • A service will be provided at a particular price, or

  • A proposal or inquiry will be accepted.

The scope of services, fees, payment schedule, cancellation terms, responsibilities, timelines, intellectual-property rights, and other conditions related to an event will be governed by a separate written service agreement.

If these Terms conflict with a signed service agreement, the signed service agreement will control with respect to the services covered by that agreement.

3. ELIGIBILITY

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to submit an inquiry or use the website in a manner that creates a legally binding obligation.

By using the website, you represent that you meet this requirement.

Parents or legal guardians may use the website to plan an event for a minor.

4. PERMITTED USE

You may use this website only for lawful, personal, and noncommercial purposes, including learning about AWE’s services, viewing our portfolio, and contacting us regarding a potential event.

You may not:

  • Use the website in violation of any applicable law or regulation;

  • Copy, reproduce, publish, distribute, sell, license, or commercially exploit website content without prior written permission;

  • Download or use photographs, logos, graphics, designs, branding concepts, written copy, or event ideas for another event or business;

  • Use content from the website to create a competing product, service, event design, or commercial offering;

  • Use automated tools, bots, scrapers, crawlers, or similar technologies to collect website content or information;

  • Attempt to gain unauthorized access to the website, its servers, accounts, databases, or related systems;

  • Introduce viruses, malware, malicious code, or other harmful technology;

  • Interfere with the security, availability, functionality, or operation of the website;

  • Impersonate another person or misrepresent your identity, business, or affiliation;

  • Submit false, fraudulent, misleading, threatening, abusive, defamatory, or unlawful information; or

  • Use the website in a manner that could harm AWE, our clients, vendors, employees, contractors, reputation, or legal rights.

We reserve the right to restrict or terminate access to the website if we reasonably believe that a user has violated these Terms or applicable law.

5. INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its original content are owned by or licensed to Ali Weitzman Events LLC.  This content may include:

  • Written text;

  • Photographs and videos;

  • Event designs and concepts;

  • Graphics and illustrations;

  • Logos and branding materials;

  • Page layouts;

  • Color palettes;

  • Invitations and printed materials;

  • Signage;

  • Custom décor;

  • Digital content; and

  • Other creative materials.

Website content is protected by copyright, trademark, trade dress, and other applicable intellectual-property laws.  The Ali Weitzman Events name, AWE name, associated logos, slogans, and branding may not be used without our prior written permission. You may view the website and save or print limited portions for your personal, noncommercial reference. This permission does not grant you ownership of any content or the right to reproduce, modify, distribute, publish, display, sell, license, or create derivative works from that content. No website content may be copied, downloaded, screenshotted, reproduced, altered, republished, displayed, transmitted, distributed, sold, or commercially used without written permission from the applicable rights holder.

6. EVENT DESIGNS AND CONCEPTS

Event concepts, mood boards, brand boards, themes, logos, layouts, décor plans, signs, personalized details, and other creative materials displayed on the website may represent substantial creative work by AWE and its collaborators. You may not use, reproduce, adapt, direct another planner or vendor to recreate, or commercially exploit these materials without written authorization. The appearance of an event concept on the website does not place that concept in the public domain or grant permission to use it. Certain general themes, colors, styles, or ideas may not be eligible for exclusive legal protection. However, original artwork, logos, written copy, graphics, photographs, and specific creative arrangements may remain protected.

7. THIRD-PARTY MATERIALS

Certain photographs, logos, videos, venues, products, artwork, designs, décor elements, music, trademarks, or other materials displayed on the website may be owned by clients, photographers, videographers, venues, vendors, artists, MitzvahLogos.com, or other third parties. The display of third-party materials does not transfer ownership to AWE or grant website users permission to copy, reproduce, or use those materials. Third-party names, logos, trademarks, products, and services remain the property of their respective owners.

8. PORTFOLIO PHOTOGRAPHY AND VIDEOS

Photographs and videos displayed on the website are presented to illustrate AWE’s previous work, creative capabilities, and event-planning experience. AWE may not own every item or creative element shown in a photograph or video. Rights may be held by AWE, the client, photographers, videographers, designers, venues, vendors, artists, or other contributors. You may not download, screenshot, edit, repost, publish, reproduce, distribute, sell, or commercially use portfolio photographs or videos without permission from all applicable rights holders. Any use of client event photographs by AWE will be governed by applicable agreements, releases, permissions, and legal requirements.

9. COPYRIGHT AND INTELLECTUAL-PROPERTY CONCERNS

We respect the intellectual property rights of others. If you believe that content displayed on the website infringes your copyright, trademark, or other intellectual-property rights, please contact us at ali@awe13.com. Your notice should include:

  • Your full name and contact information;

  • Identification of the work or material you believe is protected;

  • Identification and location of the material you believe is infringing;

  • A description of why you believe the use is unauthorized;

  • Documentation showing your ownership or authority to act for the owner;

  • A statement that the information you provided is accurate and submitted in good faith; and

  • Your physical or electronic signature.

We may remove or restrict access to disputed material while reviewing a complaint. Submission of a complaint does not guarantee that the material will be removed.

10. INFORMATION YOU SUBMIT

You may submit information through contact forms, email, telephone, questionnaires, consultation requests, or other communications. When you submit information, you represent that:

  • The information is accurate to the best of your knowledge;

  • You have the right and authority to provide it;

  • It does not violate another person’s privacy, publicity, intellectual property, contractual, or other legal rights;

  • It does not contain unlawful, fraudulent, threatening, defamatory, abusive, or harmful material; and

  • You are not submitting the information for an unlawful or deceptive purpose.

Submitting an inquiry does not guarantee that AWE will:

  • Accept the engagement;

  • Reserve an event date;

  • Provide a proposal;

  • Respond within a particular time;

  • Offer a particular service; or

  • Agree to a particular budget.

Please do not submit highly sensitive personal information through a general website form unless specifically requested. Our collection and use of personal information are addressed in our Privacy Policy.

11. TESTIMONIALS AND REVIEWS

Testimonials and reviews displayed on the website reflect the experiences and opinions of the individuals who provided them. Individual experiences may vary. A testimonial does not constitute a promise, warranty, or guarantee that another client will receive the same experience or result. We may make limited edits to testimonials for spelling, grammar, length, formatting, or clarity, provided that the edits do not materially change the reviewer’s intended meaning. We will not knowingly publish false or materially misleading testimonials. When required by applicable law, we will disclose material relationships, compensation, gifts, discounts, or other incentives associated with a testimonial or endorsement.

12. THIRD-PARTY WEBSITES AND SERVICES

The website may contain links to third-party websites, social-media platforms, venues, vendors, photographers, publications, products, or services. These links are provided for convenience and informational purposes only. A link does not necessarily mean that AWE:

  • Endorses the third party;

  • Controls the third party;

  • Guarantees the third party’s services;

  • Has reviewed all third-party content; or

  • Is affiliated with the third party.

We are not responsible for the availability, accuracy, security, privacy practices, products, services, content, or business practices of third-party websites or organizations. Your access to and use of a third-party website are governed by that third party’s own terms, policies, and practices.

13. VENDORS AND VENUES

AWE may identify, recommend, coordinate with, or provide links to independent venues, vendors, contractors, entertainers, designers, caterers, photographers, transportation providers, rental companies, or other third parties. Unless otherwise stated in a signed agreement, these third parties are independent businesses and are not employees, agents, partners, or legal representatives of AWE. The inclusion or recommendation of a vendor or venue on the website does not guarantee that the vendor or venue will be available, suitable, error-free, properly licensed, insured, or capable of meeting a client’s expectations.

Responsibilities regarding vendor selection, contracting, payments, performance, cancellation, liability, and insurance will be governed by the applicable service agreement and vendor contracts.

14. WEBSITE AVAILABILITY AND ACCURACY

We make reasonable efforts to keep the website accurate and up to date. However, we do not guarantee that all website information will always be complete, accurate, current, available, or error-free.

Information regarding services, personnel, vendors, venues, event availability, pricing, portfolio content, and business practices may change without notice.  We reserve the right to:

  • Add, remove, or modify website content;

  • Correct errors or omissions;

  • Change the website design or functionality;

  • Suspend or restrict access;

  • Discontinue any part of the website; or

  • Perform maintenance at any time.

We are not responsible for losses caused by temporary website unavailability, technical errors, outdated content, or reliance on general website information.

15. NO PROFESSIONAL ADVICE

The website does not provide legal, financial, tax, insurance, medical, safety, or other regulated professional advice. Any general information regarding contracts, budgets, vendors, insurance, permits, accessibility, food service, alcohol service, transportation, or event safety should not be treated as a substitute for advice from an appropriately qualified professional. You are responsible for obtaining any professional advice necessary for your circumstances.

16. PRIVACY

Your use of the website is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information. The Privacy Policy is incorporated into these Terms by reference.

By using the website, you acknowledge that internet transmissions and electronic communications cannot be guaranteed to be completely private or secure.

17. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis. AWE disclaims all express and implied warranties, including warranties of:

  • Merchantability;

  • Fitness for a particular purpose;

  • Title;

  • Non-infringement;

  • Accuracy;

  • Availability;

  • Reliability; and

  • Security.

We do not warrant that:

  • The website will always be available and uninterrupted;

  • Website content will always be accurate, complete, or current;

  • The website will be free from errors, viruses, or harmful components;

  • Defects will always be corrected;

  • Communications submitted through the website will always be received;

  • The website will be compatible with every device or browser; or

  • Use of the website will produce a particular result.

Nothing in these Terms excludes a warranty, protection, or right that cannot legally be excluded under applicable law.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Ali Weitzman Events LLC and its owners, officers, employees, contractors, representatives, and agents will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to:

  • Your access to or use of the website;

  • Your inability to access or use the website;

  • Your reliance on website content;

  • Errors or omissions in website content;

  • Third-party websites, vendors, venues, products, or services;

  • Unauthorized access to information transmitted through the website;

  • Loss of data;

  • Website interruptions or security incidents;

  • Viruses, malware, or harmful code; or

  • Any other matter relating solely to the website.

This limitation applies regardless of the legal theory asserted and even if AWE has been advised that damages may occur.

To the extent that liability cannot be completely excluded, AWE’s total liability for any claim arising solely from your use of the website will not exceed one hundred dollars.

These limitations do not apply to liability that cannot legally be excluded or limited.

Liability relating to paid event-planning, event-design, branding, or consulting services will be governed by the applicable signed service agreement rather than this website-use provision.

19. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Ali Weitzman Events LLC and its owners, officers, employees, contractors, representatives, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising out of or relating to:

  • Your unlawful or unauthorized use of the website;

  • Your violation of these Terms;

  • Information or content you submit;

  • Your infringement of another person’s intellectual property, privacy, publicity, contractual, or other legal rights;

  • Your misuse of website content; or

  • Your intentional misconduct.

This provision does not require you to indemnify AWE for liability caused by AWE’s own unlawful conduct, or to the extent indemnification is prohibited by applicable law.

20. GOVERNING LAW

These Terms and any dispute arising out of or relating to the website will be governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.

Mandatory consumer-protection rights or other legal rights that cannot be waived will remain applicable.

21. JURISDICTION AND VENUE

Except where applicable law provides otherwise, any legal action or proceeding arising out of or relating to these Terms or your use of the website must be brought in an appropriate state court located in Delaware or in the United States District Court for the District of Delaware. You and AWE consent to the personal jurisdiction and venue of those courts. This section applies only to disputes involving the website or these Terms. A separately signed service agreement may contain different dispute-resolution, governing-law, or venue provisions.

22. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to the website, our services, business practices, or applicable legal requirements. When changes are made, the “Last Updated” date at the top of the page will be revised. Updated Terms become effective when posted, unless a later effective date is stated. Your continued use of the website after the revised Terms become effective constitutes acceptance of those Terms.

23. TERMINATION

We may suspend, restrict, or terminate your access to the website at any time if we reasonably believe that:

  • You violated these Terms;

  • Your conduct presents a legal, security, or operational risk;

  • Your conduct could harm AWE or another person; or

  • Restricting access is necessary to comply with the law.

Provisions that by their nature should remain effective after termination will survive, including intellectual property, disclaimer, limitation of liability, indemnification, governing law, and dispute provisions.

24. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision will be severed. The remaining provisions will continue in full force and effect.

25. NO WAIVER

AWE’s failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision in the future. A waiver will be effective only when it is in writing and signed by an authorized representative of AWE.

26. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without AWE’s prior written consent. AWE may assign its rights and obligations in connection with a merger, acquisition, sale of assets, restructuring, change in ownership, or other lawful business transaction.

27. ENTIRE AGREEMENT

These Terms and the Privacy Policy constitute the entire agreement between you and AWE concerning your use of the website. They do not replace, amend, or supersede a separately signed:

  • Client service agreement;

  • Event-planning agreement;

  • Design agreement;

  • Vendor agreement;

  • Licensing agreement;

  • Model or photography release;

  • Confidentiality agreement; or

  • Other written contract.

Section headings are included for convenience and organization only. They do not limit or affect the interpretation of these Terms.
